Eh, she's fine too. I'm sure she was asking for it.
But seriously, I think the "despite the physical and circumstantial evidence, the Department of Justice has declined to investigate" part is especially weird.
So, perhaps I'm missing something, but does the company really have any liability? It would be nice if they fired the guy if he's guilty, but he hasn't been found guilty of anything. (And they don't have to be nice.) Yes, she's a victim and it's awful, but people get wrongfully accused all the time. I mean, if the company is somehow interfering with her pressing charges against the guy, or involved in the DoJ weirdness, then she is probably pretty screwed with having to go through arbitration. But even if she could sue the company... what could she expect them to do if no guilt has been shown? This is all very strange. |

I would imagine that yes, there is a legal argument to be made that they are in some way liable, since a lawyer probably took the case. |
