Why did they have to give up the child though? Carrying the kid for 9 months has to count for something.

The embryo doesn't belong to them. Carrying the kid for nine months counts for nothing, in that respect.

In a purely moral sense, think about it the other way: should the couple that created the embryo lose their (biological) child because of fertility clinic incompetence? Most, I think, would say no.

The woman carrying the kid did, however, have the right to abort the pregnancy, which is interesting.

Forced pregnancy is one of those crimes on the "war crimes top 5 greatest hits" lists, along with genocide and the like.

I just meant that it is interesting in the sense that one could construct an argument resting on the principles underlying the fact that the carrier has no legal (moral) claim to the resultant baby to argue that the carrier should not be allowed to abort it. I'm not saying I would agree, but I just think it interesting that some might very well make such an argument.

It's kind of like that episode of Family Guy wherein Peter had to carry the nest of endangered birds in his beard.
